If you were arrested in NYC and your criminal case was dismissed in the Early Case Assessment Bureau (“ECAB”) because the District Attorney’s office declined to prosecute the case, or your arrest was voided by the NYPD you will be unable to obtain a Certificate of Disposition for the arrest. An undocketed arrest letter will state that arrest date and arrest number and that it was dismissed prior to the criminal court arraignment. The undocketed arrest will serve as the final disposition of the arrest. However, it is always prudent to confirm in writing that the underlying arrest was actually sealed with the New York State Division of Criminal Justice Services.
